What a Brisbane WHS consultant actually does
A work health and safety consultant helps a person conducting a business or undertaking (a PCBU) understand and discharge its safety duties. Under section 19 of the Work Health and Safety Act 2011 (Qld), a PCBU must ensure, so far as is reasonably practicable, the health and safety of its workers and of other people affected by its work. That single duty sits behind almost everything a competent consultant does.
The phrase “so far as is reasonably practicable” is the part that trips most businesses up. It is not a fixed checklist. It requires you to weigh the likelihood and degree of harm against what is known about the risk and the cost of controlling it. A good consultant helps you make and document those judgements defensibly, rather than handing you a generic template and leaving you to guess.
Section 19(3) goes further and names specific things a PCBU must provide so far as is reasonably practicable, including a safe work environment, safe plant and structures, safe systems of work, safe handling and storage of substances, adequate welfare facilities, the necessary information, training, instruction and supervision, and monitoring of worker health and workplace conditions. Useful WHS consulting maps directly onto those obligations rather than to a sales brochure.
Officers carry their own duty. Section 27 of the Act requires an officer of a PCBU to exercise due diligence to ensure the business complies with its WHS duties. Due diligence has a defined meaning: keeping WHS knowledge current, understanding the operation and its hazards, ensuring appropriate resources and processes are available and used, ensuring information about incidents and risks is received and acted on, and verifying that all of this is actually happening. Safe work method statements and high-risk construction work
If your work includes high-risk construction work, section 299 of the Work Health and Safety Regulation 2011 (Qld) requires a safe work method statement to be prepared before the work starts. The statement must identify the high-risk construction work, state the hazards and risks, describe the control measures, and describe how those controls are implemented, monitored, and reviewed. We prepare and review SWMS that meet that standard and are written to be genuinely usable on site.
Principal contractors should note that their obligation under section 312 is to take all reasonable steps to obtain a copy of each SWMS before the relevant work starts. The duty to assess, monitor, and review the way that work is carried out sits elsewhere, principally in the broader duties under section 19 and the construction provisions of the Regulation.
